STANDARD LICENSE AGREEMENT
A Buyer can choose and apply the Standard or Extended License during content downloading from the site. Articles and provisions of the Extended License are different depending on certain content and by (not) obtaining permission of the content Contributor on their use. If a Buyer does not choose an Extended License for the content, or the Extended Licensing option has not been approved by the Contributor, the Buyer agrees with the provisions of the Standard License automatically.
Subject to the limitations and restrictions set forth herein, a Standard license gives User the right to use a File or to create and use a Permitted Derivative Work, all for a single application only, and only for the following purposes:
- prints, posters and other reproductions for personal use, advertising and promotional applications, including printed materials, product packaging, presentations, film and video presentations, commercials, catalogues, brochures, promotional greeting cards and promotional postcards (providing they are not for resale, license or other distribution);
- print media applications, such as books and book covers, magazines, newspapers, editorials, newsletters, and video, broadcast and theatrical displays;
- on–line or electronic publications, including web pages (but only when the pixel density for such File is limited to 1024 x 768); and
- any other uses approved in writing by Depositphotos.
Files marked “For Editorial Use Only” (hereinafter “Editorial Files”) downloaded with the Standard License can be used solely for the following purposes:
- publishing: newspapers, magazines, etc.;
- entries and publications in blogs and websites;
- articles in generalia, reference books;
- non-commercial use connected to important events;
- non-commercial presentations;
- TV programs;
- personal use;
- other purposes permitted by Depositphotos.
The Standard license does not permit User to use a File in connection with any manufacture, sale or distribution of goods (such as, without limitation, printing an image on a cap, photo calendar, clothes embroidery, etc.), unless such manufacture is specifically for one-time, personal, non-commercial use. If the User intends to use a File in more than one application, a separate license is required for each such application.
Editorial Files cannot be used for commercial purposes or in advertising.
Pursuant to the Standard license, User may store a File only in one location and transfer it to others only for reproduction purposes permitted by under the Standard License. The File may not be made available to multiple users simultaneously (for instance, by storing it on a network). If User requires the File to be in more than one location or accessible by more than one person, User must download the File from the Website for each such use or obtain an Extended License for a multi-seat license for File. Subject to all other limitations set forth herein, User may make one (1) copy of the File for back-up purposes.
The Standard license gives User the right to various pixel densities of a File, depending on the Fee paid by User for the Standard license, as set forth on the Website.
User may not make more than 499,999 copies of any File pursuant to the Standard license.
User agrees to display a copyright notice on or immediately next to each File licensed pursuant to a Standard license that is reproduced in mass media (such as printed magazines and templates), such notice to contain the following text “File licensed by www.depositphotos.com/[name of Contributor]”.
When using Editorial Files this notice is obligatory, irrespective of the place and manner the file will be used.
