DepositPhotos Rules for Responsible AI Use

These Rules for Responsible AI Use govern your use of DepositPhotos’ tools and features that involve artificial intelligence. These Rules supplement other legally binding documents that apply to your interactions with DepositPhotos.

1. Responsible use

AI provides a broad range of possibilities that may be misused. Your use of any output generated by DepositPhotos AI tools and features is governed by the applicable license agreement, which sets forth applicable authorized types of use and restrictions.

In addition to those restrictions, you may not use outputs generated by DepositPhotos AI tools and features:

• for purposes that may be defamatory, libelous, hateful, threatening, harassing, unethical, racially or ethnically offensive, as endorsement of any political parties or opinion-based movements, or in any malicious or fraudulent ways;
• to create, train, test, or otherwise improve any machine learning algorithms or artificial intelligence systems;
• to mislead others into believing that outputs were created by humans;
• to provide or obtain professional advice or otherwise engage in regulated activities;
• to create spam, viruses, similar contamination or destructive features and/or any other harmful components;
• to implement automated decision making;
• to allow third parties to engage in any of the prohibited activities above.

2. Interaction with AI tools and features

DepositPhotos is not responsible for the inputs you provide. You represent and warrant that you hold all necessary intellectual property and other rights to your inputs. You must ensure that outputs comply with these Rules and with applicable licenses before you use them.

Outputs generated through text-to-text, text-to-image, and other AI features are not human-verified. They depend on multiple variables, including your inputs, and may contain misleading or inaccurate information. You must review all outputs and use your own judgment to determine whether the outputs are appropriate for your intended use. DepositPhotos does not guarantee the truthfulness or accuracy of any outputs. No outputs represent the views of DepositPhotos.

3. Intellectual property and other rights

You must not use DepositPhotos AI tools and features to generate outputs that infringe third-party intellectual property, privacy, publicity, or other rights. You must not submit inputs protected by such rights unless you are authorized by the respective rights holders.

4. Third parties

DepositPhotos uses its proprietary AI solutions and involves third-party vendors that perform certain AI-related tasks within DepositPhotos’ products. Where possible, DepositPhotos may allow selection among different third-party vendors to produce different types of outputs within the same product. License terms governing your use of outputs may vary depending on the vendor selected.

Your inputs will be shared with the respective third-party vendors in accordance with agreements between Depositphotos (or its affiliates) and such vendors.

5. DISCLAIMER

DEPOSITPHOTOS’ AI TOOLS, FEATURES AND THEIR OUTPUTS ARE PROVIDED «AS IS», WITHOUT REPRESENTATION, WARRANTY, GUARANTEE OR CONDITION OF ANY KIND, whether EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. DEPOSITPHOTOS’ AI TOOLS, FEATURES AND THEIR OUTPUTS ARE NOT SUBJECT TO MANDATORY SUPERVISION OR INTERFERENCE. USERS ACCESS AND USE THESE FEATURES, TOOLS AND OUTPUTS AT THEIR OWN RISK.

DEPOSITPHOTOS HEREBY EXPRESSLY DISCLAIMS ANY AND ALL REPRESENTATIONS, WARRANTIES, GUARANTEES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO EACH AND ANY AI TOOL, FEATURE AND THEIR OUTPUTS MADE AVAILABLE AT ANY TIME, INCLUDING, BUT NOT LIMITED TO IMPLIED REPRESENTATIONS, WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, TIMELINESS, COMPLETENESS, COMPATIBILITY, CURRENTNESS, INTEGRATION, SECURITY, PRIVACY, TITLE, USEFULNESS, SUITABILITY, QUALITY, SIMPLE USAGE AND ANY OTHER WARRANTY THAT MIGHT ARISE UNDER ANY APPLICABLE LAW. DEPOSITPHOTOS MAKES NO COMMITMENTS ABOUT THE DEPOSITPHOTOS’ TOOLS AND FEATURES THAT INVOLVE AI AND THEIR OUTPUTS.

DEPOSITPHOTOS FURTHER DISCLAIMS ANY REPRESENTATIONS, WARRANTIES, GUARANTEES AND CONDITIONS THAT:

• ACCESS TO THE DEPOSITPHOTOS’ AI TOOLS, FEATURES AND THEIR OUTPUTS WILL BE UNINTERRUPTED AND ERROR-FREE AT ALL TIMES;
• DEPOSITPHOTOS’ AI TOOLS, FEATURES AND THEIR OUTPUTS WILL MEET USER’S EXPECTATIONS, WILL BE SATISFACTORY TO USER’S NEEDS AND REQUIREMENTS OR WILL BE UNINTERRUPTED AND ERROR-FREE;
• OUTPUTS WILL BE EFFECTIVE OR RELIABLE;
• ANY ERRORS OR DEFECTS IN DEPOSITPHOTOS’ AI TOOLS, FEATURES AND THEIR OUTPUTS WILL BE CORRECTED;
• DEPOSITPHOTOS’ AI TOOLS, FEATURES AND THEIR OUTPUTS WILL BE PERMITTED IN ANY JURISDICTION;
• DEPOSITPHOTOS’ AI TOOLS, FEATURES AND THEIR OUTPUTS WILL BE FREE OF VIRUSES, SIMILAR CONTAMINATION OR DESTRUCTIVE FEATURES AND/OR ANY OTHER HARMFUL COMPONENTS;
• DEPOSITPHOTOS’ AI TOOLS, FEATURES AND THEIR OUTPUTS WILL BE INTEROPERABLE WITH USER’S HARDWARE AND SOFTWARE;
• DEPOSITPHOTOS’ AI TOOLS, FEATURES AND THEIR OUTPUTS WILL BE AVAILABLE THROUGH THE SITE OR WILL BE STORED (TEMPORARY OR PERMANENTLY);
• ANY DOCUMENTS REGARDING DEPOSITPHOTOS’ AI TOOLS, FEATURES AND THEIR OUTPUTS WILL BE AVAILABLE AT ANY TIME;
• DEPOSITPHOTOS WILL CONTINUE TO SUPPORT ANY PARTICULAR AI TOOL OR FEATURE.

TO THE EXTENT ANY DISCLAIMER OR LIMITATION OF LIABILITY DOES NOT APPLY, ALL APPLICABLE WARRANTIES ARE LIMITED THIRTY DAYS AFTER THE DATE ON WHICH USER FIRST USES DEPOSITPHOTOS’ AI TOOLS, FEATURES, AND NO WARRANTIES SHALL APPLY AFTER SUCH PERIOD.

6. Miscellaneous

DepositPhotos may modify these Rules at any time, in whole or in part, and you agree to be bound by such changes. Such changes become effective upon publication. If you disagree with any provision of these Rules, you may not use DepositPhotos AI tools, features, or outputs.

Validity, interpretation and enforcement of these Rules, matters arising out of or related to performance or breach of these Rules, and related matters shall be governed by the internal laws of the State of New York (without reference to choice of law doctrine). Any legal action or proceeding concerning validity, interpretation and enforcement of these Rules, matters arising out of or related to performance or breach these Rules, and related matters, shall be brought exclusively in the State or Federal courts located in the State and County of New York. All parties consent to the exclusive jurisdiction of those courts, waiving any objection to the propriety or convenience of such venues.
